Baghmara, September 1: The Baghmara Bar Association has declined to support the demand for the removal of Meghalaya Advocate General Amit Kumar, saying it found no substantive grounds to back such a move after examining the complaint against him and his response.
In a notification issued on Tuesday, the association said it had considered a request from the Secretary of the Meghalaya High Court Bar Association and other district bar associations seeking support for Kumar’s removal.
The association said that after going through the complaint petition and the Advocate General’s reply, it found that the dispute concerned the Advocate General and the advocate involved in a particular case pending before the High Court.
“Upon careful perusal, it is found that the dispute is between the A.G and the Advocate concern of the particular case pending in the High Court,” the notification stated.
It added that the association “did not find any substantive” basis to support the demand for the Advocate General’s removal.
Baghmara lawyers will not abstain from court work
The Baghmara Bar Association also refused to join the call for abstention from judicial proceedings, citing a Supreme Court ruling against strikes by lawyers.
Referring to the Faizabad Bar Association vs Bar Council of Uttar Pradesh & Others case, the association said the Supreme Court had resolved that lawyers should abstain from work and should not endorse any strike on court working days. It further referred to Article 141 of the Constitution, under which Supreme Court judgments are binding on courts across the country.
“Therefore, we cannot take part along with the High Court Bar Association and other district Bar Association for abstention of work in the court,” the association said.
The Baghmara Bar Association has asked all its members to adhere to the rule of law and judicial precedents laid down by the Supreme Court.
