HC orders demolition of buildings near Umiam Lake if constructed without permission

SHILLONG, Sept 12: The Meghalaya High Court on Monday directed that the two offending buildings which have come by the Umiam Lake, should be demolished if they have been constructed without obtaining necessary permission.

In its order passed after hearing a PIL on the matter, the two-member bench comprising Chief Justice Sanjib Banerjee and Justice W Diengdoh said, “If the two buildings have been constructed otherwise than in accordance with law, demolition should follow in the usual course.”

The order said pursuant to the previous order of August 11, the State had informed that two buildings have come up by the Umiam Lake which have been constructed without obtaining necessary permission or clearance.

The State has filed an affidavit indicating that closure notices have been issued.

The bench has added the Khasi Hills Autonomous District Council (KHADC) as a respondent to the present proceedings since the land in question at both sites may have been owned or under its control.

Advocate for the State will indicate the owners of the two offending buildings for such owners also to be added as respondents to the present proceedings and given notice, it said.

The next hearing on the matter will be held on September 22.
